Welcome to The Mint Mark. These Terms of Service (“Terms”) govern your access to and use of our website, online store, and services (collectively, the “Site”) operated by The Mint Mark (“we,” “us,” or “our”), located in Salt Lake City, Utah.

By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

The Mint Mark sells original paintings and related art products. All paintings are unique, hand-created artworks unless otherwise explicitly stated.

2. User Accounts

You may need to create an account to make purchases. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

3. Products, Pricing, and Orders

  • All prices are listed in U.S. Dollars (USD) and are subject to change without notice.
  • We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear fraudulent or contain errors.
  • Product descriptions and images are provided for informational purposes. While we strive for accuracy, slight variations in color, texture, or appearance may occur due to photography, monitor settings, or the handmade nature of the artwork.

4. Payment

Payments are processed securely through Shopify Payments and other approved gateways. By placing an order, you authorize us to charge the payment method provided.

5. Shipping and Delivery

Shipping times are estimates only and are not guaranteed. Risk of loss and title for purchased items pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers.

6. Return and Refund Policy

7. Intellectual Property

  • All original paintings, images, text, graphics, logos, and content on the Site are the intellectual property of The Mint Mark or our artists and are protected by U.S. copyright and trademark laws.
  • Purchasing a painting grants you ownership of the physical artwork only. No reproduction rights, copyright, or commercial usage rights are transferred unless explicitly agreed in writing.
  • You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

8. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose.
  • Submit false or misleading information.
  • Attempt to gain unauthorized access to any part of the Site.
  • Engage in any activity that interferes with or disrupts the Site.

9. Limitation of Liability

To the fullest extent permitted by law, The Mint Mark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of our products.

Our total liability to you for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.
